While the church is rebuilding the Spiritual walls of this nation and the world, some individuals in the Family court system are actively trying to destroy what the Lord has called us to rebuild.  These individuals are actively trying to destroy the foundation of our societies, and our church, our families. On July 20th, 2012, my two older children were forcefully removed from my shared equal custody solely based on my religious right to pray with them a prayer I had posted on my refrigeratorEphesians 6:11-18.  As unbelievable as this might seem in the United States of America, I believe that this happened because a new form of tyranny which has been silently brewing before our very own eyes, and it is imperative that we stop it before it destroys that which our forefathers built and so many of our veterans have fought and died for.

The Merriam-Webster dictionary defines democracy as a form of government in which people choose leaders by voting; an organization or situation in which everyone is treated equally and has equal rights.  At the heart of democracy is the concept of choice. Without choice, there can not be a democracy.  When we vote for the president, a governor, a federal or state representative, we should always have a choice.  If voters do not have a choice, we can no longer call this system of government a democracy, but a tyranny.  I thought that tyrannies were long gone, especially in the U.S., one of the premier examples of democracy around the world, but to my surprise, I came to find out about one of the most subtle but most dangerous forms of tyrannies in my own flesh.

Democracy is analogous to a person, and just like a person can be divided into three equally important parts: Body, Mind, and Soul; the person of Democracy as created by our forefathers, can be divided in three equally important parts or systems, also known as powers: Executive, Legislative and Judicial powers. The Executive power is equivalent to our physical body, the one that carries out the actions of our thoughts, and the desires and judgments of our souls.  It is the most visible of all powers, and the one we can most easily associate with the person of Democracy. Governor Scott is the representative of this power in the State of Florida, where I reside, and that is why the petition is addressed to him. The Legislative power is equivalent to our minds, the organ that processes our thoughts. It looks at the natural laws of our universe, analyzes the problems a nation might be facing, and creates laws to best solve these problems for the benefit and betterment of its people. The Judicial power is equivalent to our souls, that invisible Divine breath of life that tells us what is right and wrong.  It interprets and decides the true “spirit” of our laws, weights issues as in a balance, and judges the true intentions of a nation’s heart.  A sick judicial system is one of the most dangerous diseases for a democratic nation. Just like when a person has a sick soul, and one can not correctly judge between right or wrong, where there is a sick judicial system, a government can not correctly differentiate between what is right or wrong for its people.  Such a sick judicial system calls “evil good and good evil, puts darkness for light and light for darkness, bitter for sweet and sweet for bitter” (Isaiah 5:20).

Unfortunately, underneath the radar to most voters, a new form of tyranny has been forming, which I have termed “judicial tyranny.”  It is caused by the violation of one of the most basic principles of democracy, the principle of choice.  At least in the Miami-Dade County area, where I live, a great number of judicial races are currently ran without giving voters a choice. Instead, a specialized body of attorneys decides what attorneys are qualified to run in a judicial race, and despite Florida having a great number of unemployed or underemployed attorneys, many of these judicial races only have a single candidate for it.  For instance, in the biggest judicial circuit in Florida, Miami-Dade county, about 80% of judicial races, only have a single candidate running for it, and when this happens, this lone candidate does not even have to appear on the ballot for a confidence vote, but is actually reelected automatically without receiving a single vote from the voters. So, in all Florida, the great majority of judges are reelected by default.  This loophole has opened the door to a tremendous amount of abuse and anomalies, as I have personally witnessed myself, and as I have been able to read via the internet, it is also happening in many other states, and in one degree or another, all around the country.

I believe that the judicial tyranny currently experienced in some parts of Florida and the U.S. is reaching massive proportions, causing a very serious sickness at the very soul of this nation, and that this illness is threatening the very own existence of this most blessed nation. The solution to the sickness plaguing this nation lies in the restoration of this nation’s soul, its judicial system, one judge at a time, but for that we need to make judges accountable to the people they are supposed to serve.  As Floridians, we can not do much with judges in other states, but we should be able to decide who our judges should be and if they are doing a good job or not. Unfortunately, today, this is not the case, and this the main reason why this new form of tyranny is showing its head.

The solution to this problem is simple: the judicial system, like the other two powers of the government, must be fully accountable to the will of the people, and for that, Family Court judges must appear for reelections at the General Elections whether to face an opponent or for a confidence vote from the people they serve (and not at the Primary Elections alone, like must judges are doing now, where only a fraction of voters appear, and where the smaller number facilitates their influence by special interest groups in Family Court). If this simple solution were implemented, judges would think twice before abusing their power, trampling on the constitution, and the laws they are supposed to uphold, for if they did so, they would have to face unsatisfied voters come General Election time.  In my case, a series of judicial anomalies have allowed this terrible form of abuse which clearly violated my constitutional rights of freedom of speech and religion, setting a very dangerous precedent against Florida residents who could face losing these most basic rights if the Florida Attorney General, and the Governor did not intervene on my and my children’s behalf.

Just ask yourself a question, if this form of constitutional abuse is allowed to go unchecked, what would prevent it from happening to you and your family?  Next thing you know, you could have your children taken away for believing in God and teaching your children the same. Forget about prayer in school, you might not be even be able to freely pray with them at home, as it was my case.  Please, do not be naive thinking that this is not possible, if not, just look at Nazi Germany not to long ago, or even today, the many religious intolerant countries around the world. I believe that the legal ramifications set forth by this case pose a very dangerous legal precedent against Christians, Jewish, Muslims, and parents of all faiths, in violation of two of the most important rights of our nation, and as such, I would like to request your signature petitioning Florida Attorney General, Pam Bondi, and Governor Rick Scott to intervene in this case, and that his office performs an independent investigation of this or any other unfair practices in the 11th Circuit Family Court System, where these constitutional abuses took place.

Remember also that although as Christians we are called to be subject to authority (Romans 13:1), we are above all, also called to obey God rather than man (Acts 5:29), and when these men are violating our God given freedoms and rights, we are supposed to stand against them, united as ONE, for greater is He who is in us than him who is in the world (1 John 4:4).

We as Christians in Florida can be a catalyst of positive change in our judicial system by exercising a clause in ARTICLE V, Section 10, 3(b) of the Florida Constitution: “…a circuit may initiate the local option for merit selection and retention or the election of circuit judges, whichever is applicable, by filing with the custodian of state records a petition signed by the number of electors equal to at least ten percent of the votes cast in the circuit in the last preceding election in which presidential electors were chosen.” For instance, to cause a sweeping reform of the 11th circuit court of Miami-Dade County, it would only take 88,803 signatures, or 10% of the votes cast at last presidential elections. Now, as James reminds us “whoever knows the right thing to do and fails to do it, for him it is sin” (James 4:17), so let us do the right thing.

Not Fasting, But Justice Says the Lord

Is not this the fast that I have chosen: to loose the bonds of wickedness, to undo the bands of the yoke, to let the oppressed go free, and that you break every yoke? Is it not to divide your bread with the hungry and bring the homeless poor into your house—when you see the naked, that you cover him, and that you hide not yourself from [the needs of] your own flesh and blood? Then shall your light break forth like the morning, and your healing shall spring forth speedily; your righteousness shall go before you, and the glory of the Lord shall be your rear guard. Then you shall call, and the Lord will answer; you shall cry, and He will say, Here I am. If you take away from your midst yokes of oppression [wherever you find them], the finger pointed in scorn [toward the oppressed or the godly], and every form of false, harsh, unjust, and wicked speaking, And if you pour out that with which you sustain your own life for the hungry and satisfy the need of the afflicted, then shall your light rise in darkness, and your obscurity and gloom become like the noonday. And the Lord shall guide you continually and satisfy you in drought and in dry places and make strong your bones. And you shall be like a watered garden and like a spring of water whose waters fail not” (Isaiah 58:6-11, AMP).  “For I desired mercy, and not sacrifice; and the knowledge of God more than burnt offerings” (Hosea 6:6; also: Matthew 9:13, and Matthew 12:7).

As in the Old Testament, God is calling all Christians to break the bonds of wickedness and every yoke. God is not satisfied in our sacrifices but in our hearts, in our desire and actions to care for each other. As a child of God, when God allows us to see and experience any evil, it is not because He is mad at us (because He already took His anger in the body of Christ, the Lamb of God), but because He knows that He can count on us to replace whatever evil we might be facing with good, the good works which God prepared beforehand that we should walk in them (Ephesians 2: 8-10), for we are his hands and feet, the light of the world (Matthew 5:14-16); we are temples of the living God, the most powerful force of the universe, of the power that resurrected Christ from the grave and for this reason we say that with God nothing is impossible.  Unfortunately, just like it happened with Israel, some of us have not yet realized our purposes in this life. We continue to try to please God with our sacrifices, our fasting, our praying, our tithing, etc, (not that their is anything inherently wrong with them) but God is clear throughout the Bible that he is not pleased with our righteousness, for it is to Him like filthy rags.  As the passages above show, and Isaiah 58 clearly expresses, God is not pleased in our sacrifices, our fasting (in other translations in fasting and prayers) but in our desire to get rid of injustice and evil from this world. For this reason, I ask Christians of all denominations to join me if fighting evil and injustice in all its forms, and so DO His will, for faith without works is dead. Not only that, but Christ told us in John 17: 20-13, that it would be the UNITY of His followers what would cause the evangelization of the whole world, and with it, the second coming of Christ. So, in obedience to Christ’s wishes, unite with me in this just cause to protect the religious freedom of Floridians by signing this petition. Christ’s wish is our command!

In my case, I had the privilege to experience a very prevalent evil that is destroying children and families in our cities, and I believe that God wants you and me to work to replace this evil with good, to be His hands and feet to help bring His Kingdom and will to this world in this area of life. I invite you to join me in this fight. Prayers and fasting in this area are appreciated, but according to God, are not enough. The evil I am facing is the existing corruption/incompetence in the Miami-Dade Family Court system, the same one that in great part is responsible for the suffering and death of many children in the State of Florida, including a child named Nubia Barahona (whose innocent blood is still crying out to God, and who was not even officially counted as one of the 477 innocent children who have recently died under Florida’s Family Court system care), and who died at the hands of her foster parents in great part as a consequence of a corrupt/incompetent system.

In my case, the same psychologist, Mrs. Vanessa Archer, who said Jorge Barahona, the man who killed Nubia and tortured her brother, was fit to be a foster parent and whom ignored clear evidence to the contrarywas the same incompetent psychologist (see report by clicking here), that hid and manipulated evidence in my case, and questioned my parental abilities due to my Christian values for having prayed the Armor of God of Ephesians 6:11-18 with my children, while 3 corrupt/incompetent judges in the 11th Circuit Family Court selectively enforced the Law, ignored the facts of this case, and made decisions in favor of their attorney friends.

One of these Judges, probably the most corrupt/incompetent of them all, Pedro Echarte went as far as refusing to read the final report from the Department of Children and Families (DCF) that cleared me from these false accusations on the ridiculous ground that it had been performed one day prior to him giving the order to do so, but whom had agreed to take away my shared custody solely on allegations made to the same DCF (4 different cases up to that point, 2 of them just the year before, 5 false accusations in total to this day). He then went ahead and order the evaluation with the clearly anti-Christian, and incompetent Vanessa Archer, knowing fully well the disaster she had caused in the Barahona case, without even getting a slap in her hand for it; but on the contrary, she was promoted instead to evaluate cases like mine in the Miami-Dade Family Court system. No wonder so many innocent children have died under the supervision of these incompetent individuals, who believe that some how they are above the Law, but who have sworn to uphold it.

The connection between the incompetence/corruption of the Family court system and the psychological/psychical abuse of children may not be very clearly seen at first sight, but I believe that a detailed study of cause and effect, would clearly show the association.  The problem starts when some of those at the top of the Family court system, namely some judges abuse the power bestowed to them by the people, and begin to selectively enforce the laws to benefit a special number of them, special interest groups.  The arbitrary and arrogant decisions taken by some of these judges demoralize and discourage those underneath them, namely the rest of the Family court system. These judges believe that they are above the law, and the constitution, and believe themselves some form of god.  They blatantly make decisions against firmly established constitutional principles, such as in my case, of freedom of religion, and get away with it because of the interests that protect them. Then, an environment of intimidation and fear forms which negatively affects the entire Family court system leading to its present state of affairs. Those underneath them better be quite, comply with their arrogant ways, or they will be targeted, demoted or get fired.

The abuses go on, and no one is willing to speak. From time to time some courageous reporters see the immensity of the problem, but they only see the surface of the issues, the most visible and outrageous ones at that, such as the cases of the 477 children who have been killed under the jurisdiction of our Family court system.  In good conscience, these reporters look everywhere, and start blaming many factors, such as lack of money, changes in the law that promote family preservation, etc, but must of them have failed to see the root cause of these issues: the incompetence/corruption of some judges in the Family court system.  For every one child that has died under the supervision of the Family court system, there are probably hundreds if not thousands of children emotionally abused because of the incompetence/corruption of these individuals.  Take for instance my case, probably just one of thousands out there ( I personally know several patients of mine with similar family court issues that have caused great damage to their children and parents involved). My Son, Mario Simon, for instance, after recovering recovering shared custody of him and his sister went the mother had absconded with them for 2 years in another country, my son went from scoring in the top quartile in the FCAT, and being given the honor of student of the month (one of the proudest moments of his and my life), while in my shared custody, to  my son almost failing 4th grade, to causing his teachers serious concerns due to his inappropriate behavior and very poor gradesto  being diagnosed with Major Depression, and PTSD and requiring medication for it. Then, to make matters worst, I was recently notified that he had developed involuntary movements of his shoulders and neck most likely as a negative side effect of his current psychiatric medications, which he was forced to take due to incompetence/corruption of the Family court judges in my case.  I hope that my case will open the eyes of the Florida Governor, and Attorney General so that they can move quickly and investigate the atrocities being committed by these individuals. For this reason, I plead to your love as parents and human beings, and request your signature to petition Florida Governor, and Attorney General to intervene not only on my and my children’s behalf, but on behalf of the possibly thousands of children unnecessarily suffering at this time.

Now, I believe that the Governor’s and Attorney General’s intervention can only provide a temporary relief to this problem, but Floridians deserve better. So, I have come up with a more permanent solution, which I have termed: Restoring Our Nation’s Soul One Judge At A Time, see details HERE. In summary, the solution provides a way to check and balance the Judicial system, restoring the power originally bestowed on the people by our Nation’s founders by a Florida constitutional amendment that would require all judges serving the people of Florida to appear on the ballots for a yes or no confidence vote.  This simple change could potentially put a stop to the Judicial abuses Floridians have grown so accustomed to seeing, and which my case is a living example of.  See Constitutional Amendments & Initiative Petitions Frequently Asked Questionsand Guide for Florida Voters for more information.

Doing some more intensive research, I also recently found another possible solution to make judges accountable for their actions: “The voters in each circuit may exercise a local option for merit selection and retention of circuit court judges. A circuit may initiate the local option by filing with the secretary of state a petition signed by a number of voters equal to at least 10% of the votes cast in the circuit in the most recent presidential election.
